These terms govern your use of emscote.co and the services provided by Emscote Arden Solutions FZC, registered at Sharjah Publishing City Free Zone, United Arab Emirates.
1 Our services
Build is a one-off service from $699. We configure and hand over a reusable outbound operating system for you to operate. Build and Run starts from $1,000 per month and includes configuration and operation of agreed outbound activity. For Build and Run, the agreed volume of outbound activity is set for each engagement according to the market opportunity and the Client’s mailbox and deliverability setup. Fractional Sales starts from $1,500 per month and also includes working responses through to qualified opportunities. The exact scope and commercial terms of each engagement are agreed in writing. That agreement takes precedence over these terms if there is any conflict.
2 Website content
Website content is provided for general information. Named companies and example emails are illustrative unless clearly stated otherwise.
3 Fees and payment
Commercial terms for each engagement are agreed in writing, with fees set out in the applicable proposal or service agreement. Invoices are issued at the start of each month and are payable within seven days of the invoice date. Interest of ten per cent per month may be charged on any amount unpaid more than twenty-one days after the due date, accruing daily until paid. All fees are exclusive of applicable taxes.
4 Acceptable use
You must not use the website or our services unlawfully, or in a way that harms the website, our services or others.
5 Intellectual property
All intellectual property in the website, our methods and the materials we create remains ours unless expressly transferred under a written agreement.
6 Confidentiality
Each party must keep the other party’s non-public information confidential and use it only for the engagement.
7 Limitation of liability
We provide our services with reasonable care and skill. To the fullest extent permitted by law, we are not liable for indirect or consequential loss, or loss of profit. Our total liability for an engagement is limited to the fees paid for that engagement. Nothing in these terms limits liability that cannot be limited by law.
8 Term and termination
Engagements run on a monthly rolling basis. Either party may terminate by giving written notice of at least seven days during the first month, fifteen days during the second month, and thirty days from the third month onwards. Termination does not affect fees for work performed up to the effective date of termination.
9 Qualified opportunities
A Qualified Opportunity is a lead that fits the agreed Ideal Customer Profile and has expressed clear interest in the Client’s products or services. This may include requesting a call, asking for more information, or indicating a desire to explore working together.
10 Governing law
These terms are governed by the laws of the United Arab Emirates.
